1. Introduction
These Competition Terms & Conditions (“Terms”) govern all promotional competitions, ambassador programmes, referral programmes, prize draws and similar promotional activities (“Competitions”) conducted by FanArc Studio (Pty) Ltd (“FanArc”, “we”, “our”, “us”).
By participating in any FanArc Competition, participants agree to be bound by these Terms together with the applicable Competition Schedule.
Where a Competition Schedule differs from these Terms, the Competition Schedule shall prevail only to the extent of the inconsistency.
2. Promoter
Unless otherwise stated within a Competition Schedule, the promoter is:

Where a Competition is conducted jointly with a commercial partner, both organisations may be identified as co-promoters within the applicable Competition Schedule.
3. Eligibility
Unless otherwise specified within a Competition Schedule:
Competitions are open to all registered FanArc users.
Certain Competitions may impose additional eligibility requirements, including age restrictions, where required by law or by a participating commercial partner.
Employees, directors and contractors of FanArc may not participate in FanArc Competitions.
4. Acceptance of these Terms
Participation in any Competition constitutes acceptance of:
these Competition Terms & Conditions;
the applicable Competition Schedule;
FanArc’s General Terms and Conditions; and
FanArc’s Privacy Policy.
Participants who do not agree with these Terms should not participate in any Competition.
5. Competition Period
Each Competition Schedule shall specify:
Competition Opening Date
Competition Closing Date
Winner Determination Date
Prize Distribution Date (where applicable)
Entries received outside the Competition Period shall not be considered.
6. Prizes
Each Competition Schedule shall specify:
the available prize(s);
the number of winners;
any prize-specific conditions.
Unless otherwise stated:
prizes are not transferable;
prizes may not be exchanged for alternative goods or services;
FanArc reserves the right to substitute a prize with another prize of equal or greater value where reasonably necessary.
7. Winner Verification
Prior to awarding any prize, FanArc reserves the right to verify that participants satisfy the applicable eligibility requirements and have complied with these Competition Terms and the relevant Competition Schedule.
FanArc’s determination of eligibility and compliance shall be final.
8. Fraud Prevention
FanArc is committed to maintaining fair and transparent Competitions.
FanArc reserves the right to investigate activity reasonably believed to involve:
duplicate accounts;
fake accounts;
automated registrations;
bots;
manipulated referrals;
self-referrals;
fraudulent purchases;
abuse of Competition mechanics;
technical exploitation; or
any attempt to gain an unfair advantage.
FanArc may remove invalid entries, disqualify participants, withhold prizes or permanently exclude users from future Competitions where fraud or abuse is identified.
FanArc’s decision following such investigation shall be final.
9. Privacy
Participation in Competitions requires FanArc to process personal information for the purposes of:
administering Competitions;
determining winners;
awarding prizes; and
communicating Competition-related information.
Personal information will be processed in accordance with FanArc’s Privacy Policy and applicable South African legislation.
10. Publicity
By participating in a Competition, participants agree that FanArc may publish their FanArc username together with details of any prize won across FanArc marketing channels.
11. Winner Notification & Prize Delivery
Competition winners will be notified via an in-app notification.
Prizes will be delivered directly to the winner’s FanArc inbox unless otherwise stated within the applicable Competition Schedule.
12. Limitation of Liability
To the maximum extent permitted by law, FanArc shall not be liable for:
delayed or failed entries;
technical failures;
network interruptions;
third-party service failures;
Competition interruptions caused by circumstances beyond FanArc’s reasonable control.
Nothing within these Terms limits any consumer rights afforded under applicable South African law.
13. Changes or Cancellation
FanArc reserves the right to amend, suspend or cancel any Competition where reasonably necessary, including where required due to technical issues, fraud, legal requirements, operational considerations or circumstances beyond FanArc’s reasonable control.
Where a Competition is conducted jointly with a commercial partner, both organisations will agree on any necessary Competition changes or cancellation.
14. Governing Law
These Terms shall be governed by the laws of the Republic of South Africa.
Addendum
Competition Schedule 1 - Ambassador Program
1.Purpose
The Ambassador Challenge rewards FanArc users who successfully introduce new members to the FanArc community.
2.Competition Cycle
The Ambassador Challenge operates on a monthly basis. Only qualifying referrals earned during a calendar month shall count towards that month’s Competition.
Winners shall be determined on the 1st day of each month based on the total number of qualifying referrals in the prior month.
3.How to Participate
Participants may invite new users to FanArc using their unique referral link.
A referral shall be considered a Qualifying Referral only once:
The participant has opted into the Ambassador Challenge and generated their unique referral code and referral link;
The referred person registers using the participant’s referral code or link; and
The referred person submits at least one valid race prediction before the Competition closes.
Only Qualifying Referrals count towards the monthly leaderboard.
4.Invalid Referrals
The following referrals shall not qualify:
duplicate accounts;
self-referrals;
fake accounts;
suspended accounts;
referrals generated through automated means;
referrals determined by FanArc to be fraudulent.
5.Qualifying Referral Status
A Qualifying Referral must remain an active FanArc profile at the time winners are determined.
Profiles that have been deleted prior to winner determination shall not contribute towards a participant’s total Qualifying Referrals for scoring purposes.
6.Winner Determination
The Ambassador Challenge is a performance-based competition.
On the 1st day of each calendar month, the three participants with the highest number of Qualifying Referrals earned during the preceding calendar month shall be declared that month’s winners.
Where two or more participants have the same number of Qualifying Referrals, the participant whose final Qualifying Referral was achieved first shall be ranked higher.
7.Prizes
Unless otherwise announced:
1st Place - R500 Takealot Voucher
2nd Place - R250 Takealot Voucher
3rd Place - R100 Takealot Voucher
Prizes shall be delivered directly to each winner’s FanArc inbox.
8.Verification
FanArc reserves the right to verify Qualifying Referrals prior to awarding prizes.
Invalid referrals may be removed at any stage.
9.Winner Announcement
Winning usernames may be published across FanArc communication channels following completion of the monthly Competition.
